Personal data and cookies

This Policy on the protection of personal data (hereinafter the “Policy”) is that of Yan Haltey Brands Sàrl, a Swiss company with its registered office at Rue Saint-Martin 32, 1005 Lausanne, Switzerland, entered in the Commercial Register under UID no. CH-550-1195939-0 (hereinafter “YHB” or “we”).
The purpose of this Policy is to inform you about the ways in which YHB processes your personal data (hereinafter the “Personal Data”) and about the rights available to you in this regard. It applies as soon as you access this website.
All communication must be addressed to our customer service (hereinafter “Customer Service”), reachable via the contact form or by email at contact@yanhaltey.com.
Article 1 · Legal framework
The processing of your personal data is governed by the Federal Act on Data Protection (FADP, SR 235.1) and by the Ordinance on Data Protection (DPO, SR 235.11).
To the extent that YHB uses third-party services whose servers are located in the European Union, or which process the data of European Union residents, the relevant requirements of the General Data Protection Regulation (GDPR, EU Regulation 2016/679) are taken into account in the choice and configuration of those services.
In accordance with art. 19 FADP, this Policy constitutes the information provided to data subjects at the time their personal data is collected.
Article 2 · Data collected on the website
When you visit our website, we automatically collect certain information about your device, in particular information about your web browser, your IP address, your operating system, your time zone and some of the cookies installed on your device.
As you browse the site, we also collect information about the pages viewed, the third-party sites or search terms that referred you to our site, and the way you interact with the site.
If you use our forms (contact, appointment booking, online assessment, newsletter sign-up), we collect the information you voluntarily provide: surname, first name, email address, telephone number, answers to the questionnaires, message. The telephone number is used solely to contact you again in connection with your request.
Article 3 · Sensitive data
YHB does not intentionally collect sensitive data within the meaning of the FADP (data on health, political opinions, religious beliefs, ethnic origin, genetic or biometric data).
If you voluntarily provide information of this nature in your exchanges, YHB does not process it in any specific way and applies to it the same protection measures as to all your data.
Article 4 · Data not collected
YHB does not directly collect complete banking data (card number, CVV), which is processed exclusively by our payment providers. Nor does YHB collect precise geolocation data.
Article 5 · Purposes of processing
We only process the data necessary for the purposes for which it was collected:
- Delivery of services : management of advisory, creative and support services.
- Communication about services : follow-up of requests, appointment reminders, information about services.
- Payment and invoicing : processing of payments, issuance of invoices.
- Service improvement : anonymized and aggregated analysis of website use.
- Advertising performance measurement : measuring the effectiveness of our online advertising campaigns.
- Marketing communication : sending of newsletter, offers, editorial content, only if you consent to it.
- Security : detection and prevention of unauthorized access, fraud and security incidents.
- Legal obligations : retention of accounting data, response to requests from the competent authorities.
YHB does not sell or rent your personal data. The data passed to third-party providers as part of advertising measurement is limited to what is strictly necessary.
Article 6 · Legal bases
The processing necessary for the delivery of services, communication about services, payment and invoicing rests on the performance of the contract that binds us.
The processing related to service improvement, advertising performance measurement and security rests on an overriding interest of YHB. You may object to it via the cookie management banner or on legitimate grounds relating to your particular situation.
The processing related to marketing communication rests on your consent. You may withdraw it at any time.
The processing related to accounting and legal obligations rests on the legal obligations imposed on YHB.
Article 7 · Sharing of data
We share your personal data only with the categories of recipients described below, strictly to the extent necessary for the purposes mentioned in Article 5.
Article 8 · Delivery partners
When you activate a delivery service, the data strictly necessary for carrying out the service (elements of the specifications, brief, content you have approved) may be passed to the partner concerned. This transfer is limited to the scope of the service you have approved. The partners are subject to the confidentiality obligations set out in the general terms of the service mandates.
Article 9 · Hosting and location of data
Your personal data is hosted in Switzerland. Certain technical processors may process data abroad, in particular for the sending of emails and text messages, audience analysis and advertising performance measurement. Such processing may notably take place in the European Union, in Singapore or in the United States.
Article 10 · Technical processors
YHB calls on technical providers for the operation of the website. These providers process personal data on behalf of YHB.
The categories of processors we use are the following: hosting, payment, email, text messaging, audience analysis, advertising measurement and search engine optimization.
We select our processors taking into account their commitments in terms of data protection and security.
Article 11 · Authorities
We may be required to disclose personal data to the competent authorities where the law demands it (legal obligation, judicial decision, criminal investigation).
Article 12 · No other recipient
Apart from the cases described in Articles 8 to 11, we do not pass your personal data to third parties.
Article 13 · Retention periods
We keep your personal data only for as long as is necessary for the purposes for which it was collected, or for the period imposed by the law.
Browsing and form data is kept for the period necessary for the purposes for which it was collected.
Invoicing data and accounting data is kept for the period required by the applicable legal obligations.
Article 14 · Rights guaranteed by the FADP
In accordance with the FADP, you have the following rights:
- Right of access (art. 25 FADP) : obtain a copy of your data and the information relating to its processing.
- Right to rectification (art. 32 para. 1 FADP) : request the correction of inaccurate or incomplete data.
- Right to erasure (art. 32 para. 2 let. c FADP) : request the deletion of your data, subject to legal retention obligations.
- Right to portability (art. 28 FADP) : receive your data in a structured and commonly used format.
- Right to object : object to processing based on an overriding interest of YHB.
- Right to withdraw your consent : withdraw a consent given, at any time.
Article 15 · Exercising your rights
To exercise your rights, send your request in writing to Customer Service. We may ask for proof of identity to verify your identity.
We reply within a period of 30 days. This period may be extended by a further 30 days in the case of a complex request, with notification.
Exercising your rights is free of charge. We may refuse to act on requests that are manifestly unfounded or excessive.
Article 16 · Right of appeal
If you consider that the processing of your personal data does not comply with the applicable legislation, you may contact the competent data protection authority.
Article 17 · Security measures
We implement appropriate technical and organizational measures to protect your personal data against any unauthorized access, use, alteration or disclosure.
Access to the data is limited to persons who have a legitimate need in the course of their duties. All our staff and processors are bound by a confidentiality obligation.
However, no transmission of data over the Internet or over a wireless network can be guaranteed.
Article 18 · Types of cookies
Cookies are small text files placed on your device when you visit the website.
Strictly necessary cookies are indispensable to the operation of the website (security, session). They cannot be disabled.
Analytical cookies make it possible to measure traffic and analyze user behavior in order to improve the service. You can disable them via the cookie management banner or via your browser settings.
Advertising measurement cookies make it possible to measure the effectiveness of our online advertising campaigns. You can disable them via the cookie management banner.
Third-party cookies may be placed by certain integrated services (video player, podcast player). We do not control these cookies and invite you to consult the privacy policies of the services concerned.
Article 19 · Managing cookies
You can configure your preferences via the cookie management banner, set your browser to refuse all or part of the cookies, or delete cookies already placed. Refusing strictly necessary cookies may prevent access to certain features.
Article 20 · Minors
YHB’s services are intended for an adult audience (18 years of age and over). We do not knowingly collect personal data from minors.
Article 21 · Amendment of the Policy
We may amend this Policy at any time. Amendments take effect as soon as they are published on the website. The version date is shown in the header of the document.
Article 22 · Governing law and place of jurisdiction
This Policy is subject exclusively to Swiss law. As regards jurisdiction, any subsequent dispute concerning the interpretation of the Policy will be submitted to the ordinary courts of Lausanne.
